Written Answers. - Non-Payment of Inheritance Tax.

88 Mr. Aylward asked the Minister for Finance if he will instruct his Department to withdraw legal proceedings in respect of the non-payment of inheritance tax, including interest, against a person (details supplied) in County Laois who is 70 years of age and whose only income is a non-contributory old age pension. [18155/96]

I am informed by the Revenue Commissioners that the person in question was afforded numerous opportunities over many years to settle the arrears of inheritance tax. Legal proceedings were instituted as a last resort and only when all other avenues for recovery had been exhausted. Having regard to the person's age and financial circumstances the Revenue Commissioners are taking proceedings with the intention of obtaining a judgment mortgage against the property which was inherited. The effect of this will be to defer payment of the tax until the death of the person involved or until the property is sold.
