Question:

271 Mr. Bree asked the Minister for Social Welfare when an official in his Department will reply to a letter of 30 October 1996, regarding the case of a person (details supplied) in County Sligo. [22740/96]

In this letter of 30 October the Deputy requested a copy of correspondence issued to the person concerned regarding her right to appeal a decision to reject her claim for deserted wife's benefit. These notifications are of a standard format and copies are not kept for individual cases. A reply to this effect issued to the Deputy on 25 November.

In the case in question, deserted wife's benefit was awarded with effect from 1 December 1994 on the basis of the information furnished by the person concerned with her application of 17 May 1995. An earlier claim in November 1991 was refused. However, the case has been further reviewed and it has now been decided to award deserted wife's benefit with effect from the date of the original claim i.e. November 1991. Payment of arrears due will be made as soon as possible.
