Batt O'Keeffe

Question:

74 Mr. B. O'Keeffe asked the Minister for Health if he is concerned that duplicated legal fees may be sought from the hepatitis C tribunal and the private individual as a result of awards made at the tribunal. [23948/96]

Limerick East): I propose to take Questions Nos. 73 and 74 together.

The proceedings of the compensation tribunal are private as set out in clause 6 (b) of the compensation scheme, a copy of which I am forwarding to the Deputy. I am not, therefore, in a position to supply the Deputy with the details he has sought in relation to an individual claimant.

Clause 18 of the compensation scheme sets out the procedures governing the awarding of legal costs and expenses to claimants to the tribunal.

Clause 20 of the scheme deals with reports by the compensation tribunal to the Minister for Health on the operation of the compensation scheme etc. and the laying by the Minister for Health of copies of such reports before each House of the Oireachtas. Clause 20 states that such reports shall, in so far as it is practicable, not identify any claimant.
