My statutory responsibility in relation to the insurance sector is to ensure that insurance companies adhere to solvency rules. The question of whether or not an act of God may be used as a defence against liability insurance claims is a matter of legal interpretation and ultimately for the courts to decide. In general, under a liability insurance policy no liability will attach where an act of God is proven as the proximate cause of the loss.
