Question:

159 Mr. Callely asked the Minister for Justice if she will give details of the EU directives, regulations and conventions in respect of which her Department has responsibility and which have not been transposed into or made part of Irish law; and the timescale for completion of the work in respect of each instrument. [25117/96]

The information sought by the Deputy in relation to my Department is as follows:

1. Convention on the Protection of the European Communities' Financial Interests and Protocols linked to that Convention.

Timetable for Implementation

Legislative proposals to implement the Convention and Protocols are currently under preparation with a view to publication in 1997.

2. Convention on Simplified Extradition Procedures between the Member States of the EU.

Timetable for Implementation

Primary legislation is necessary to enable the ratification of the Convention and will be brought forward as soon as possible.

3. EU Convention on Extradition.

Timetable for Implementation

Primary legislation is necessary to enable the ratification of the Convention and will be brought forward as soon as possible.

4. Convention on the establishment of a European Police office (Europol), and its subsequent Protocol.

Timetable for Implementation

Work on the Bill to enable Ireland to ratify the Convention and its subsequent Protocol is being given priority in my Department and I expect to be in a position to publish a Bill early in 1997.

5. Council Directive 95/46/EC on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of such Data.

Timetable for Implementation

The Directive must be transposed into Irish law by 24 October, 1998.

The legislative measures needed to give effect to the Directive, which will involve changes to the Data Protection Act, 1988 will be brought forward as soon as possible with a view to enactment prior to October 1988.

6. Council Directive 91/308/EEC on the Prevention of the use of the Financial System for the purpose of Money Laundering.
Timetable for Implementation
Legislation to enable Ireland to give effect to the Directive has been enacted and is in operation. Article 11 of the Directive has so far been implemented on an operational basis, but will be given statutory effect by the Criminal Justice (Miscellaneous Provisions) Bill which is currently before the Houses of the Oireachtas.
7. The Rights of Residence Directives 90/364, 90/365, 93/96.
Timetable for Implementation
These Directives have been transposed into Irish law. However, further amendments are required to ensure that the domestic regulations giving effect to these Directives are fully in line with the Directives. Amendments have been prepared and will be ready shortly for my signature.
