Ceisteanna—Questions. - Holding of Referenda.

Question:

4 Mr. M. Kitt asked the Taoiseach the referenda, if any, which will be held in 1997. [1381/97]

As I have previously informed the House, the Government is committed to initiating a constitutional amendment Bill on Cabinet confidentiality. Work is proceeding on its drafting. Pending the receipt and consideration of the report of the All-Party Committee on the Constitution, it is not possible to indicate the further referenda, if any, which might be held in 1997 arising from that Committee's work.

What is the Government's commitment on a referendum on votes for emigrants? Will the Government repeal the Official Secrets Act, 1963, before a referendum on Cabinet confidentiality?

The position as regards votes for emigrants was set out in previous replies by both myself and the Minister for the Environment. There are no proposals to hold a referendum on that issue during 1997. There is no proposal to change the Official Secrets Act, 1963. The Act does not apply to Ministers but to others. Therefore it is not relevant to any changes which might occur as regards Cabinet confidentiality.

There were media reports that the Government had looked for formal advice concerning the holding of a referendum, a general election and a possible Presidential election on the same date. If the Government has obtained this advice, what are its proposals?

The Government obtains advice all the time on all matters which affect any contingencies that may arise. There is no particular significance in any advice we may have received on any of the matters referred to by the Deputy.

As regards the referendum on Cabinet confidentiality, has consideration been given to the need for a system of recording Cabinet meetings?

It would be best to debate and discuss that matter when the wording is produced. I do not think such recording is necessary.

In relation to Cabinet confidentiality, is the Taoiseach aware that under the Committees of the Houses of the Oireachtas (Compellability, Privileges and Immunities of Witnesses) Bill, 1995, which we are currently discussing in committee, the Government is proposing to extend the definition of Cabinet confidentiality?

The question deals with possible referenda.

It is relevant in the context of a referendum being held.

It is not appropriate for me to enter into discussion here of matters being discussed in a committee.

Is the Taoiseach aware?

Given that there will be a general election in 1997, does the Taoiseach agree it would make sense to hold the Cabinet confidentiality referendum on the same day?

It might and it might not.
