Vol. 474 No. 1

Written Answers. - Employment Appeals Tribunal.

Noel Ahern

Question:

168 Mr. N. Ahern asked the Minister for Enterprise and Employment if he will have arrangements made for an early payment for a person (details supplied) as agreed under the employment appeals tribunal. [2575/97]

The decision of the Employment Appeals Tribunal in the case in question, which concerns appeals under the Redundancy Payments Acts, 1967 to 1991 and the Minimum Notice and Terms of Employment Acts, 1973 to 1991, has not yet issued to the parties.

Where a favourable decision is received from the tribunal in the redundancy case and the employer refuses or is unable to pay the appropriate statutory entitlement, the person concerned should contact the redundancy payments section of my Department for payment from the Social Insurance Fund. Every effort will be made to process the payment without delay.

Where a minimum notice award is granted, the person concerned should seek payment from the employer in the first instance. If the matter is not settled satisfactorily, the employment rights section of my Department may be contacted for further information.
