267 Mr. Moynihan asked the Minister for Agriculture, Food and Forestry if he will have arrangements made to pay compensation to a person (details supplied) in County Cork in respect of a BSE affected animal disclosed in his herd. [3026/97]

Under present BSE legislation, compensation is payable in respect of an affected or suspected animal which is caused to be slaughtered for the purposes of investigation as to whether the disease is present or where a suspect animal dies following the placement of restrictions on movement from the holding. In this case the farmer's own veterinary surgeon removed the head from the suspect animal before movement restrictions were put in place and compensation is therefore not payable.

However, the herdowner concerned has been paid the market value for the remainder of his herd which has now been depopulated.
