Question:

58 Mr. Aylward asked the Minister for Health if he will instruct the South Eastern Health Board to have a death certificate issued to a person (details supplied) in County Kilkenny. [13013/97]

Limerick East): The administration of the registration system is statutorily a matter for An tÁrd-Chláraiteoir (Registrar-General) of Births, Deaths and Marriages, and for the local registrars who act under his general direction.

I have been advised that the death of the person in question was the subject of a post mortem examination and was referred to the coroner. As provided by section 50 of the Coroners Act, 1962, — Number 9 of 1962 — a coroner can either elect to hold an inquest into the circumstances which gave rise to a death, or decide as a result of a post mortem examination not to hold an inquest. In either event the coroner must furnish to the registrar of Births and Deaths a certificate containing the relevent details to enable the registration of the death. The registrar is obliged by law to await te coroner's certificate.

I understand that the date of the coroner's inquest in this case remains to be determined.
