Adjournment Debate. - Assessment of Means.

I thank the Chair for affording me the opportunity of raising this matter on the Adjournment. I congratulate the Minister on his appointment to the Department of Social Welfare of which I have some knowledge. I wish him every success.

The matter I raise relates to a reply to a parliamentary question tabled yesterday. The information in the reply was needed for a specific purpose today. A more serious problem may have been created because the information is out of date. The reply states that the assessment is based on self-employment and that this is based on the most recent figures available to the Department. On closer examination it was found that one of the most recent assessments was in 1993. Two Governments have come and gone since then.

The information should be updated for three reasons. First, a long time has elapsed; second, legislation relating to seasonal and part-time workers has changed in the meantime which would make it more beneficial to the person concerned; and, even more important, the whole source of the part-time employment which was in existence at that time has gone. That is the vital element which needed to be updated and brought to the attention of the Department. The assessment does not reflect that position. I am not attributing blame to the Minister. It is the fault of the system. It is important that up to date information is available at all times. I merely ask the Minister to examine the case in question. Up to date information would eliminate much of the confusion for the individual concerned.

I thank the Deputy for raising this issue which was the subject of a parliamentary question tabled by him yesterday. The person concerned is in receipt of unemployment assistance at a reduced single rate on the basis of a means assessment of £33 per week. The means are derived from self-employment and are based on the most recent figures furnished to the Department by the person concerned. The means are assessed for a 12 month period up to 3 October 1995, not 1993. I accept the Deputy's comments and ask him to supply any information that would assist the Department in dealing with this matter.

The man in question was interviewed on a number of occasions about his earnings from self-employment. The inspector dealing with the case is satisfied the assessment is reasonable having regard to the man's circumstances, but is not satisfied the person concerned has ceased self-employment. The most recent decision on this case was given on 12 May 1997 by a deciding officer in my Department. The person concerned did not appeal this decision nor has he claimed supplementary welfare allowance from the community welfare officer, to which he would be entitled based on the amount of money he is receiving.

If the circumstances of the person concerned have changed it is open to him to seek a further review of his means and a form for this purpose can be obtained at his nearest local office. In the meantime payment of unemployment assistance will continue to issue at the reduced rate. Deputy Durkan should encourage this man to seek a review of his means and the Department will examine all the circumstances.
