Question:

177 Dr. Upton asked the Minister for the Environment and Local Government whether his consent was required for the sale of land (details supplied) by a local authority. [16300/97]

In accordance with regulations made under the Local Government Act, 1991, the disposal of land under section 83 of the Local Government Act, 1946 does not require ministerial consent where the disposal is at the best consideration reasonably obtainable. Bundoran UDC sought ministerial consent to the disposal of certain lands, while stating, based on senior counsel's opinion, that the disposal was at the best consideration reasonably obtainable. My Department's legal adviser advised me that in these circumstances, I had no function in the matter. The UDC were informed accordingly on 12 August 1997.
