Question:

81 Mr. Stagg asked the Minister for the Marine and Natural Resources if his Department has received a request from Sligo Harbour Commissioners seeking approval for the leasing of harbour board property (details supplied) in County Sligo to a person (details supplied) who did not submit a tender in respect of the property; his views on whether this is normal procedure; and if he will make a statement on the matter. Sligo Harbour Commissioners have sought approval under section 157 of the Harbours Act, 1946, to lease the property referred to and the prospective lessee is the person referred to by the Deputy.

I am advised that standard procedures in accordance with public procurement guidelines appear to have been followed in the processing of tenders for the property in question. My Department's investigations in the matter are not yet completed fully and legal advice is awaited on the issue.

Pending receipt of the legal advice sought by my Department, it is not possible for the Department to complete these investigations in the matter nor for me to determine the application for statutory approval of the lease arrangement.
