Written Answers. - Telecommunications Masts.

15 Mr. Currie asked the Minister for Public Enterprise the proposals, if any, the Government has to introduce legislation to facilitate or develop co-location by Eircell and ESAT or any subsequent licensed telecommunications operator on Garda masts throughout the country; if her attention has been drawn to the investment proposals in this regard recently submitted to the Government; if she will outline the Government's views on this proposal; and if she will make a statement on the matter. 55 Mr. McDowell asked the Minister for Public Enterprise when regulations to give effect to the Interconnection of Networks Directive 97/33/EC will be signed; and the proposals, if any, she has to provide for the mandatory sharing of masts and other telecommunications infrastructure. [18964/97]

I propose to take Questions Nos. 15 and 55 together.

EU Directive 97/33/EC, which deals, among other things, with interconnection of telecommunications networks, requires member states to put in place before 31 December 1997 measures to ensure facility and property sharing by organisations providing telecommunications networks and publicly available telecommunications services. Regulations to implement the directive in Ireland will be signed before that date.

The directive provides that arrangements for co-location or facility sharing shall normally be a matter for commercial and technical agreement. It requires however that national regulatory authorities, that is, the Director of Telecommunications Regulation in Ireland, must have powers to intervene to resolve disputes. Facility or property sharing arrangements may only be imposed after an appropriate period of public consultation during which all interested parties must be given an opportunity to express their views.

These requirements will be reflected in the regulations to implement the directive.

I fully support the principle of sharing of masts and other telecommunications infrastructure on the basis of commercial agreements in order to promote economic efficiency and minimise the adverse environmental impact of telecommunications infrastructure.

The implementation in Ireland of the interconnection directive will require operators such as Esat Digifone and Eircell to share facilities owned by them. I am also considering the question of bringing proposals to Government for a Bill dealing with this and related regulatory issues in the telecommunications sector.
In relation to the investment proposals referred to by Deputy Bruton, I presume he is referring to the proposal by Eircell to use Garda masts and to upgrade the masts where necessary to accommodate up to four operators. This matter has not yet been considered by the Government and the Minister for Justice, Equality and Law Reform will determine if and when proposals will be brought to Government in this regard.
