85 Mr. Neville asked the Minister for the Marine and Natural Resources if his attention has been drawn to the fact that eight members of Foynes Port Company have threatened High Court proceedings against a number of parties; and if he has agreed to indemnify these board members and cover their legal costs in a court action in view of the Bord na Móna case in 1996. [19317/97]

The Foynes Port Company have confirmed that the company and eight of its directors have threatened legal action as referred to by the Deputy. I have not been asked, nor have I agreed, to idemnify any costs of litigation.

There is no provision in the Department of the Marine Vote to indemnify directors of port companies against legal costs incurred. I am advised that no such indemnification was provided in the case referred to by the Deputy.
