Question:

575 Mr. N. Ahern asked the Minister for Health and Children if his Department will issue a birth certificate to a person (details supplied) in Dublin 11 which, despite a court application, has not been issued due to errors in the original registration. [1649/98]

The administration of the registration system is a matter for the Registrar-General of Births and Deaths and for local registrars who operate under his general direction.

The birth to which the Deputy referred was not registered, as is required by the Births and Deaths Registration Acts 1863 to 1994, because the member of the hospital staff who signed the register as qualified informant was not permitted in law to do so, having regard to the circumstances of the birth. This did not arise from any wilful disregard of the law by the informant as the full circumstances of the birth were not made known to the informant prior to the registration of the birth. An tArd Chláraitheoir is taking advice to determine the means which may be available to him to resolve the difficulties in this and a small number of similar cases.
