Question:

792 Mr. Aylward asked the Minister for Justice, Equality and Law Reform the progress to date on the application under section 49 of the Registration of Title Act, 1964, which was lodged on 7 February 1996 by a person (details supplied) in County Kilkenny. [2005/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 — i.e. acquisition of title by virtue of long possession — of the Registration of Title Act, 1964, which was lodged on 7 February 1996. I understand that due to their complicated nature applications under section 49, which require detailed examination of the applicant's claim for registration as owner, take some time to process.

I am informed that queries have been raised in this case which have been put to the applicant's solicitor. These queries must be satisfactorily discharged before the matter can proceed. Finally, I can confirm that the Land Registry will do everything possible to expedite the resolution of this application.
