Question:

268 Mr. Callely asked the Minister for Education and Science if he will take the necessary steps to prevent the receiver of a club (details supplied) in Dublin 3 selling the Clontarf site which is the property of his Department; if he will give an undertaking to place an injunction on the sale; and if he will make a statement on the matter. [2400/98]

I have been legally advised that the only interest which the company has in the property the subject of this question is, at most, a yearly lease. My Department is being advised of the steps necessary to terminate that interest and repossess the property. In the meantime, any purported sale of the property by the receiver appointed to the company cannot succeed as the company does not own the property.
