Question:

124 Mr. M. Kitt asked the Minister for Defence if the Army authorities have set down guidelines and regulations for the work practices of Army personnel; if the sanctions and penalties on the breaking of these regulations are listed; and if he will make a statement on the matter. [4052/98]

Pursuant to the provisions of the Safety, Health and Welfare at Work Act, 1989, safety statements, setting down guidelines for work practices in the particular places of work, have been drawn up in respect of each workplace. The sanctions and penalties prescribed in the Safety, Health and Welfare at Work Act, 1989, apply equally to the Defence Forces as to other workers, except in relation to exempted activities, as specified in Regulation 3 of the Safety, Health and Welfare at Work (General Application) Regulations, 1993. These exemptions apply when members of the Defence Forces are on active service or deemed to be on active service as defined in the Defence Acts, 1954 and 1960; engaged in action in the course of operational duties at sea; engaged in operations in aid of the civil power, or engaged in training directly associated with any of these activities.
