Question:

33 Mr. Coveney asked the Minister for Health and Children the name of the insurance company that provided insurance for the North-Western Health Board which paid agreed compensation on behalf of the health board in settlement of the action brought in the McColgan case; the nature of the insurance cover provided by the health board and, in particular, whether this health board and the other seven health boards in the State are insured against actions for negligence arising out of alleged failures by a health board to take care proceedings on behalf of children who are reported to be at risk or whom the health board should know are at risk. 131 Mr. Shatter asked the Minister for Health and Children the name of the insurance company that provided insurance for the North-Western Health Board which paid agreed compensation on its behalf in settlement of the action brought in the McColgan case; the nature of the insurance cover provided and, in particular, whether this health board and the other seven health boards in the State are insured against actions for negligence arising out of alleged failures by a health board to take care proceedings on behalf of children who are reported to be at risk or whom the health board should know are at risk. I propose to take Questions Nos. 33, 40 and 131 together.

Insurance cover in the McColgan case was provided to the North-Western Health Board by Irish Public Bodies Mutual Insurances Ltd.

IPB provides public liability cover to all eight health boards. The extent of such cover depends on the circumstances surrounding each individual claim. It is not possible to state categorically that cover would operate in all circumstances as set out in the question. All insurance policies are subject to various terms and conditions and it is, therefore, not possible to comment on the extent of cover in a hypothetical situation.
