Question:

101 Mr. Creed asked the Minister for Agriculture and Food the situation regarding ownership of quota allocated by the milk quota tribunal; and if he will clarify the situation regarding ownership where the quota holder intends to cease production. [7593/98]

Quota allocated by the milk quota appeals tribunal is for the use of the named successful applicant only and must not be transferred by way of sale or lease of land, may not be sold under a cessation or restructuring scheme and may not be transferred by way of a temporary lease. The only circumstances in which this quota may be transferred is where the holding of the successful applicant is being transferred to a successor. All successful applicants are informed of these conditions.
