264 Mr. Rabbitte asked the Minister for Justice, Equality and Law Reform if the statistics furnished to his Department by the Garda authorities and included by the then Minister in the reply to Parliamentary Question No. 169 of 6 February 1996 and subsequently included in the bound volume of Parliamentary Debates No. 461, in which it was stated that a member of the Garda convicted of common assault in 1995 was allowed to remain in the force, were correct; and if he will make a statement on the matter. Question:

265 Mr. Rabbitte asked the Minister for Justice, Equality and Law Reform the number of Garda Síochána convicted of criminal conduct and common assault who were allowed to continue to service in the force in each of the years from 1990 to 1995. [10090/98]

I propose to take Questions Nos. 264 and 265 together.

The figure furnished by the Garda authorities to my Department, and included in the reply to Parliamentary Question No. 169 of 6 February 1996 with regard to the number of gardaí convicted of criminal conduct and assault for the year 1995 but retained in the force was nil. This is the correct figure. Unfortunately, the figure contained in the Official Report is not correct.

The tabular statement below sets out the number of gardaí convicted of criminal conduct and common assault who were allowed to continue to serve in the force in each of the years from 1991 to 1995, inclusive. Figures for 1990 are not included as records for that year are not readily available to the Garda authorities.
