Question:

185 Mr. Allen asked the Minister for the Environment and Local Government if he will give details of the formal Government decision taken in October 1997 in relation to the disposal of lands in the Dublin dockland area; if he will confirm that any of these lands can only be disposed of with the authorisation of his Department; and if he will make a statement on the matter. On 25 November 1997 the Government decided: first, that lands in the Dublin docklands area owned by statutory bodies surplus to requirements in the performance of their statutory functions should be identified and should, in general, be offered for sale to the Dublin Docklands Development Authority at full market value under the transfer mechanism provided in section 28 of the Dublin Docklands Development Authority Act, 1997; and second, that alternatively, in cases where a statutory body wishes to carry out certain property development activities in relation to its surplus lands in the DDA, the relevant Ministers should direct the statutory body concerned and the DDDA to negotiate the terms of an approach under which the DDDA would become involved, jointly with the statutory body, in the redevelopment of the lands in question on a basis which reflects the obligations and legitimate interests of both parties.

The making of a transfer under section 28 of the Act of 1997 by the Minister for the Environment and Local Government is subject to the consent of the appropriate Minister and the Minister for Finance.
