Vol. 491 No. 7

Written Answers. - Registration of Title.

Jack Wall

Question:

199 Mr. Wall asked the Minister for Justice, Equality and Law Reform if he will ensure an early decision regarding registration of title (details supplied) in view of the fact that the delay is causing financial problems for the persons involved. [13245/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 — acquisition of title by virtue of long possession — of the Registration of Title Act, 1964. I understand that due to their complicated nature, applications under section 49, which require detailed examination of the applicant's claim for registration as owner of the property, take some time to process.

I am further informed that a formal objection to this section 49 application has been received from solicitors acting on behalf of a third party. The Land Registry is awaiting further documentation from this third party's solicitors in relation to their objection.
