Written Answers. - Dishonourable Discharges.

Question:

91 Mr. Rabbitte asked the Minister for Defence if he has received a submission from a former military policeman (details supplied) who was subject to a dishonourable discharge from the PDF in 1975; if he will request the Defence Forces to reopen the case in view of the efforts this person has made over 20 years to clear his name and the new evidence produced in his submission; and if he will make a statement on the matter. The former member of the Permanent Defence Force referred to was discharged from the Permanent Defence Force in 1975 on the grounds of his services being no longer required. The person in question instituted High Court proceedings to have the decision by the military authorities to discharge him set aside. The High Court upheld the decision to discharge him and this was confirmed, on appeal, by the Supreme Court.

In view of the circumstances outlined above and as the individual concerned is no longer a serving member of the Defence Forces, there is no action open to me in this case.
