Question:

88 Mr. Gormley asked the Minister for the Marine and Natural Resources if his attention has been drawn to the fact that sand is being taken from many of our beaches by individuals in JCBs and tractors; the plans, if any, he has to introduce legislation to stop this practice; and if he will make a statement on the matter. The Foreshore Acts 1933 and 1992 enable me to take action in relation to the illegal disturbance or removal of beach material from specified areas of seashore or State-owned foreshore by way of the issue of prohibitory notices or the making of prohibitory orders, a breach of which would be an offence punishable by a substantial fine and/or term of imprisonment. The 1992 Act moreover specifically empowers the courts to order the mitigation or remedy of the effects of any illegal removal or disturbance in such manner and within such period as they may specify. Action is normally taken following consultation and in co-operation with the appropriate local authority, the Garda and other interested parties.

If the Deputy has any particular area or areas in mind, I shall pursue urgently the question of appropriate action in the light of the facts he supplies to me.
