Question:

379 Mr. Higgins (Mayo) asked the Minister for Justice, Equality and Law Reform the number of fines remitted under the Criminal Justice Act, 1951, since the decision of the High Court in the case taken by Judge Brennan. [15811/98]

Statistics in relation to petitions for clemency under section 23 of the Criminal Justice Act, 1951, as amended by section 17 of the Criminal Justice (Miscellaneous Provisions) Act, 1997, are maintained by reference to petitions finalised rather than to individual penalties. Details of all petitions finalised since 28 April 1995, the date of issue of the High Court judgment to which the Deputy refers, are set out below. The table shows that mitigation has been granted in respect of 73 petitions in the period concerned.
