97 Mr. Rabbitte asked the Minister for the Environment and Local Government if he has received from the Irish Home Builders Association a copy of the promised voluntary code of practice to deal with the practice of gazumping; his views on whether he considers this to be adequate to deal with the problem; and if he will make a statement on the matter. [19356/98]

The draft code of practice has not yet been approved by the Irish Home Builders Association. However, the association provided my Department with an outline of draft proposals in relation to their voluntary code last week. I understand that further elements of the code are currently being formulated. My Department will be carefully examining the association's proposals, in consultation with a number of other interested parties, with a view to ensuring, as far as possible, that the draft code is satisfactory, likely to be effective and brought into operation at the earliest possible date.
