Vol. 496 No. 2

Written Answers. - Registration of Title.

Bernard J. Durkan

Question:

165 Mr. Durkan asked the Minister for Justice, Equality and Law Reform when registration of a title for a person (details supplied) in County Kildare will be completed in respect of a property at Grannagh, County Kilkenny; and if he will make a statement on the matter. [22329/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 (i.e. acquisition of title by virtue of long possession) of the Registration of Title Act, 1964 which was lodged on 11 August 1997. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process.

I am further informed that the Land Registry issued queries on this dealing to the applicant's solicitor on 3 November 1998 and replies are awaited. The queries raised must be satisfactorily discharged before the matter can proceed.
Accordingly, it is not possible to estimate a completion date for the application concerned at this stage.
