Question:

235 Ms O'Sullivan asked the Minister for Health and Children if a decision has been made regarding the medical consent issue for children in foster care; if so, when it will be implemented; and, if not, when this decision will be made. [23140/98]

The Irish Foster Care Association and a number of health boards have raised the issue of the right of foster parents to consent in particular to major elective or emergency medical treatment for foster children in their care. As a result of these representations the Department of Health and Children has raised the issue with the Attorney General's office. The Department is currently in discussion with the Attorney General's office to clarify the issues as quickly as possible.
