49 Mr. Aylward asked the Minister for Agriculture and Food if a full investigation will be carried out on the application for a quota from the national reserve by persons (details supplied) in County Kilkenny in view of the information submitted to his Department by them on 27 June 1992. [24247/98]

The arrangements for milk producers with special difficulties under the super levy system were set out in a notice published in the national newspapers on 17 November 1984. One of the categories eligible to apply for additional quota under this scheme was that of producers whose deliveries in 1983 were seriously affected by animal disease. Eligible producers in this disease category were confined to those who had at least 10 per cent of their cows affected by brucellosis, tuberculosis or leukosis and whose deliveries of milk to a purchaser in 1983 were less than deliveries in either 1981 or 1982. The closing date for receipt of applications from these special category producers was 14 January 1985. No application was received from the persons concerned at that time.

An application was made to the Milk Quota Appeals Tribunal on 26 June 1990 and a small quota allocation was made. A subsequent application was made to the tribunal on 27 June 1992 but was unsuccessful.
It will be open to the persons in question to apply to the tribunal for an allocation of quota on hardship grounds when application forms for the 1999-2000 milk quota year become available.
