Question:433 Mr. Ellis asked the Minister for Agriculture and Food the position on the REP scheme application of a person (details supplied) in County Leitrim. [1888/99]

This case was selected at random for a compliance test. On inspection it was found that extensive clearance to internal fences and scrub was carried out prior to admission to REPs. This is a breach of measure 4 of the agri-environmental specifications. A 100 per cent penalty was imposed and consequently this applicant's participation in the scheme was terminated and a refund of moneys paid to date has been sought. The applicants were informed of their right to appeal but to date no appeal has been lodged.
