I propose to take Questions Nos. 36 and 40 together.

The circumstances which led to the court conviction of three members of the force are as follows: in case one, the member's involvement in a fatal traffic accident in Portarlington in which a pedestrian was killed; in case two, the member's association with individuals who were believed to have been peripherally involved in the murder of Veronica Guerin; in case three, the stopping of a designated doctor who was on his way to Dundalk Garda Station in order to process a prisoner who had been arrested for an offence under the Road Traffic Acts.

The internal management of the force, including the disciplining of members, is a matter for the Garda Commissioner.

I have been informed by the Garda Commissioner that disciplinary proceedings are being instigated in cases one and three. The Deputy will appreciate, therefore, that I cannot comment on these matters.

In regard to case two, I understand that the member of the Force concerned resigned and consequently disciplinary proceedings were not initiated as he was longer a member of An Garda Síochána.
