Question:

22 Mr. Gilmore asked the Minister for the Marine and Natural Resources further to Parliamentary Question No. 131 of 13 October 1998 and Parliamentary Question No. 50 of 9 June 1998 the progress, if any, made in relation to pension entitlements for the person concerned; when a decision will be made in this regard; and if he will make a statement on the matter. [3292/99]

As I assured the Deputy in my reply to Parliamentary Question No. 131 of 13 October 1998 I remain positively disposed to facilitating the participation in the relevant superannuation scheme of persons to whom the Deputy refers.

The latest advices received from the Office of the Attorney General and the Department of Finance in the matter indicate that it may not be possible to facilitate participation without amendment of the primary governing legislation, the Harbours Act, 1996, or of the submission of new superannuation schemes.
Officials of my Department and the Department of Finance are actively engaged in determining the most appropriate and valid mechanism to facilitate urgent participation in the relevant superannuation scheme by the person concerned and to bring the matter to finality as soon as possible.
