Question:

203 Mr. Yates asked the Minister for Agriculture and Food if beef cow payments will be made to a person (details supplied) in County Wexford for all but the one animal for which an erroneous claim was made in view of the circumstances whereby someone other than the applicant completed the form; and if he will review the application of a penalty in this case. Friesian cows and non-beef breeds are not eligible for grants under the 1998 beef cow scheme. The person named applied on 22 cows under the 1998 beef cow scheme, one of which (tag no. YMA 915959) was in fact a Friesian cow. My Department wrote to the person named on 12 January 1999 advising that no grants were payable to him under the 1998 beef cow scheme in accordance with clause 29 of the terms and conditions governing the scheme, which states that a producer who is deemed to have made a false declaration in his application through serious negligence will be excluded from the scheme. He has been given the opportunity to appeal this decision, by writing to my Department setting out any facts which he wishes to put forward to support this case. Any such appeal will be considered as a matter of urgency.
