Question:

343 Mr. Hayes asked the Minister for Education and Science if there is a written agreement between his Department and South Dublin County Council concerning a land exchange between both parties at the site of the Old Bawn community school in Tallaght, Dublin 24; the precise details of the ownership of the land in question; and if he will make a statement on the matter. [5794/99]

Old Bawn community school was built on a site purchased by my Department and vested in the Minister for Education in fee simple. In order to facilitate the operation of the school, the site was leased to trustees for a period of 99 years from 15 May 1981 under the terms of the standard deed of trust for community schools.

There has been a long-standing problem relating to the delineation of the site at Old Bawn and this has been the subject of discussions between my Department, the South Dublin County Council and its predecessor, the Dublin County Council. The council wrote to the Department on 10 February 1999 about the matter and a copy of this correspondence has been forwarded to the school principal.

The building unit of my Department has asked the council to forward the relevant site drawings relating to the proposals contained in their letter of 10 February 1999 and when these have been received, the matter will be considered further.
