186 Mr. Spring asked the Minister for Defence if, further to Parliamentary Question No. 116 of 9 February 1999 regarding the objection lodged by his Department with An Bord Pleanála relating to planning permission for persons (details supplied) in County Kerry, his attention had been drawn to the existence of an agreement between his Department and these persons; and his views on whether his reply is in breach of the terms of the agreement. [8492/99]

Since my reply to Parliamentary Question No. 116 of 9 February 1999, no agreement has been concluded between the landowner and the Department In relation to the lands in question. In accordance with legal advice the draft licence has not been signed by the Department pending the outcome of its appeal to An Bord Pleanála.
