130 Mr. Perry asked the Minister for Agriculture and Food if REP scheme fees paid in excess of £820 will be refunded to a person (details supplied) in County Sligo in view of the fact that he was not aware of the new framework documentation for commonage on 1 January 1999 which resulted in the non-acceptance of his REP scheme plan; and if he will make a statement on the matter. It is a condition of the REP scheme that each applicant lodges an agri-environmental plan drawn up by an approved planner with his/her application. On 28 July 1998 all planners were notified that plans involving commonage could not be accepted pending the availability of framework plans. The applicant's planner should therefore have been aware that the plan could not be submitted at that time. Any fee charged for the drawing up of a plan is a matter between the farmer and the planner involved.
