82 Mr. Browne (Wexford) asked the Minister for Agriculture and Food if an investigation will be made into the reason a ten month premium payment due to a person (details supplied) in County Wexford has not been issued. [11079/99]

Under EU regulations payment of special beef premium is subject to a stocking density limit of two livestock units per hectare of forage area, inclusive of animals submitted for ewe premium, suckler cow premium, special beef premium and units derived from any milk quota held by an applicant in the relevant year.

The person named applied for special beef premium in respect of 24 animals on 16 October 1998. He had declared a forage area of 20.76 hectares on his 1998 area aid application, thereby giving a stocking limit of 41.52 livestock units. The person named also had a milk quota of 57,099 gallons in 1998, which when divided by his average yield of 1,255 gallons, accounted for 45.49 livestock units.

As the livestock units derived from the milk quota exceed his stocking density limit, under EU regulations no payment of special beef premium can be made.
