Question:

313 Ms Clune asked the Minister for Justice, Equality and Law Reform the proposals, if any, he has to amend legislation to ensure that those convicted of driving a stolen car with speed through the streets causing death will be convicted of manslaughter; and if he will make a statement on the matter. [12889/99]

I assume the Deputy is referring to dangerous driving of a stolen car causing death.

I understand that the Road Traffic Acts, 1961 to 1995, provide for a broad range of offences, including dangerous driving, driving without due care and attention and taking a vehicle without the owner's consent. The Acts also provide for the penalties for these offences. In the case of dangerous driving causing death, the defendant is liable, on conviction on indictment, to imprisonment for up to five years and/or a fine of £3,000.

The question of the appropriate charge to be preferred in a particular case is a matter for the Garda authorities and the Director of Public Prosecutions. The question of amending the road traffic laws is a matter for the Minister for the Environment and Local Government who is responsible for all road traffic legislation.
