Question:

83 Ms O'Sullivan asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to the circumstances surrounding the summoning to attend on 3 July 1998 at Wicklow Circuit Court of a person (details supplied) in Dublin 14; the circumstances of the summons; and if he will make a statement on the matter. I am informed that the case referred to in the question was a civil action taken by three plaintiffs against two defendants. The matter came before the court on 25 July 1998 by way of ex-parte application for an interim injunction. The court dealt with the matter on that day and granted the interim injunction, making it returnable for 3 July 1998. The court also directed that a copy of the order, granted together with the Civil Bill and a Notice of Motion advising of the return date of 3 July 1998, be served on the defendants.

On 3 July 1998 both the plaintiffs and the defendants were legally represented. A number of orders were made by consent of the legal representatives of both parties, one of which amended the name of one of the defendants from the name referred to by the Deputy, to a different Christian name. I am also informed that no complaint in relation to the service of proceedings in this case was made to the court on 3 July 1998, by either of the defendants.
