Question:

141 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development the progress to date on the appeal by a person (details supplied) in County Kilkenny regarding a special beef premium. [19098/99]

The herdowner lodged an appeal on 15 July 1999 concerning his 1999 special beef premium application. This case is currently being reviewed at local office level and will subsequently be examined by the headage and premia appeals unit. The herdowner will be informed of the outcome.

142 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development if he will review the decision by his Department to reject the application under the 1999 ten and 22 month special beef premium by a person (details supplied) in County Kilkenny in view of the circumstances. [19099/99]

The person concerned submitted an application for ten and 22 month special beef premium in respect of 55 animals on 10 January 1999. This application has not been rejected. However, processing of the application revealed that one animal was slaughtered inside the retention period.

Under the terms and conditions of the 1999 special beef premium scheme each producer must notify the special beef premium unit of the loss or removal of any animals applied on, in writing, within ten working days of the event.

Without such notification, animals cannot be excused the two month retention requirement and shall be deemed to be rejected with consequential reduction penalties on all the remaining animals on that application.

The net result of this penalty will be a reduction of 1.85 per cent on the remaining 54 animals, providing all 54 are found eligible for payment.
