Question:

162 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo only received a 1999 ewe premium payment on 38 ani mals when he has a permanent quota of 54. [23343/99]

Under the ewe supplementary measure 1998, which was introduced by my Department in October 1998, flockowners with commonage land in six western counties, including Mayo, and who were not participating in an existing REPS plan were obliged to reduce their ewe numbers by up to 30 per cent and their existing permanent quota was reduced or frozen by this percentage. The reduced quota numbers will remain frozen pending the completion of detailed commonage framework plans for the individual commonages.

In the case of the person named he held a permanent quota of 54 but under the above measure this was reduced to 38 and his 1999 ewe premium and sheep headage grants were limited to this number.

Question:

163 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage. [23344/99]

The person named submitted an area aid application which included a new parcel of land in respect of which a dual claim was determined. My Department has contacted both herdowners to clarify the matter and is awaiting a response.

The herdowner also included another new parcel on his area aid application. After it was entered on the Department's electronic database, it was found to contain less than the area he had claimed. The person named has also been contacted in this regard. No payments can issue until both matters have been resolved.

164 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the land parcel numbers attributed to an area aid application of a person (details supplied) in County Mayo subsequent to his amended instructions of May 1999. [23346/99]

Consequent on the amendment of his application by the person named, the area aid unit has replaced parcel P15127019 with P15127083. A representative of the person named has arranged a meeting with the area aid unit in order to discuss other outstanding matters relating to this application. Once these matters are resolved the application will be processed with a view to making all outstanding payments at the earliest possible date.

Question:

165 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when 1998 cattle headage, sheep headage and a beef premium will be paid to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [23458/99]

The person named submitted an area aid application on which he declared 72.16 hectares of forage area in 1998. However, the documentation provided only supported an area of 50.65 hectares. This represents a difference of 21.51 hectares or 42.46 per cent between the area claimed and that found. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3 per cent, the penalty is based on double the difference when it is between 3 per cent and 20 per cent and when the difference is over 20 per cent, a 100 per cent penalty must be applied. The penalty applicable in this case was therefore 100 per cent. The person named requested copies of the digitised maps of his holding for 1998. These maps were returned to the area aid unit on 28 October 1999 with amendments. These amendments are being entered on the Department's electronic database at present and on completion the application will be reviewed.

Breeda Moynihan-Cronin

Question:

167 Mrs. B. Moynihan-Cronin asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) will be paid a second year REP scheme payment. [23494/99]

The person named was selected at random for an on-farm inspection. On foot of the inspection, an issue in relation to the removal of a fence has arisen. This matter requires further investigation in my Department. Officials in my Department will be in touch with the applicant in the near future.
