Question:

264 Mr. Ring asked the Minister for Social, Community and Family Affairs when a disability appeal will be finalised for a person (details supplied) in County Mayo. [24052/99]

The person concerned was in receipt of disability benefit from 28 March 1997. Payment was disallowed by a deciding officer from 23 December 1998 following an examination by a medical assessor who considered that she was capable of work. The person concerned appealed this decision to the Social Welfare appeals office and, arising from this she was examined by another medical assessor who was also of the opinion that she was capable of work.

The appeals officer in the case considers that an oral hearing is necessary. The appeals office will be in touch with the person in this regard in the near future.
