Question:

140 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when ten and 22 month beef premium payments and suckler cow payments will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [25617/99]

The person named applied for premium on 29 cows under the 1999 suckler cow premium scheme and for 29 beef cows under the 1999 cattle headage scheme on 3 June 1999.

Following an inspection carried out on 13 October 1999 one animal which was declared on the application form was not presented. In addition it was found that the animal in question was not in the applicant's ownership and possession on the date of application. Consequently the person in question was deemed to have made a false declaration through serious negligence which means he has no entitlement to payment under the 1999 cattle headage and 1999 suckler cow premium scheme.

At a further inspection on 22 November 1999, the person in question did not co-operate with the inspector. The applicant was notified of the decision of my Department on 25 November 1999. The notification letter indicated that it was open to the applicant to have the decision reviewed if he so wished. Therefore he has been given 21 days to seek a review and to provide evidence to support any such request.

The special beef premium application of the person named has been processed and payment will issue shortly.
