Michael Ring

Question:

131 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 sheep headage and premia. [25862/99]

(Mr. Walsh): Payment of the 1999 sheep headage grant, including top up, will be made to the person named on 8 December 1999. The person named was paid the first and second advances of the 1999 ewe premium on 11 June 1999 and 20 October 1999, respectively.

Question:

132 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage in view of the fact that any difficulties with the area aid application were fully resolved in 1998. [25863/99]

The person named applied for a total of 63.27 hectares on his 1999 area aid application form. Following processing of his application an area of 61.75 hectares was determined. This represents a difference of 1.52 hectares or 2.46% between the area claimed and that determined.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.

Therefore in this case no penalty is applied and consequently any payments due will issue based on the determined area of 61.75 hectares.

133 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive the remainder of 1998 cattle headage and premia. [25864/99]

The person named will be paid the balance of his entitlement under the 1998 cattle headage scheme, amounting to £717.77, within the next two weeks.

The person named was paid his full entitlement of £244.02 under the 1998 special beef premium ten months scheme; the advance of £216.40 was paid on 23 December 1998 and the balance of £27.62 on 17 May 1999.

The person named was paid his full entitlement of £1,402.30 under the 1998 suckler cow premium scheme based on his suckler cow quota for ten suckler cows. The 80% advance of £1,121.84 was paid to him on 18 December 1998 and the balance of £280.46 was paid to him on 3 February 1999.

He was paid his full entitlement of £379.41 under the 1998 extensification premium; £298.60 was paid to him on 8 June 1999 on the basis of the ten suckler cows paid under the 1998 suckler cow premium scheme and £80.81 was paid to him on 10 June 1999 on the basis of the three animals paid under the 1998 special beef premium scheme.
The person named was paid his full entitlement of £2,569.83 under the 1998 ewe premium scheme; the first advance of £1,207.66 was paid on 19 June 1998, the second advance of £596.63 was paid on 22 October 1998 and the balance of £765.54 was paid on 26 February 1999.

134 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 headage and premia payments in view of the fact he submitted proof of his commonage entitlement. [25865/99]

The person named applied for a total of 9.68 hectares on his 1999 area aid application form. Following processing of his application an area of 9.53 hectares was determined. This represents a difference of 0.15 hectares or 1.57% between the area claimed and that determined.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.

Therefore in this case no penalty is applied and consequently any payments due will issue based on the determined area of 9.53 hectares.

135 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle headage in view of the fact he submitted proof of entitlement as requested. [25866/99]

As stated in my reply of 23 November 1999 to Parliamentary Question No. 132, one of the parcels claimed by the person named as part of her 1999 area aid application was also claimed by another herdowner. A letter accompanied by maps issued to the person named with a view to resolving the dispute.

The person named has now responded, indicating that she does not have a right to claim the parcel in question, but actually meant to claim a parcel of land directly adjacent to this parcel. In the particular circumstances of this case, the area aid unit is prepared to regard the dual claim as an obvious error on the part of the person named and to allow the parcel concerned to be added to her application.

The application has now been fully processed, and any payments due will issue as soon as possible.

Liam Aylward

Question:

136 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development the progress to date on the appeal by a person (details supplied) in County Carlow in respect of a penalty deducted from his fourth year REP scheme payment on 24 May 1999. [25872/99]

An appeal against a 10% penalty imposed on a second year REPS payment was submitted to my Department on behalf of the person named on 1 June 1999. My Department has carried out an inspection of the farm pertaining to the appeal and the inspector's report has been received. The entire matter will be fully considered by my Department's REPS appeals committee at the earliest possible date. When a decision is taken, the person named will be informed of the outcome directly in writing.

137 Mr. Kenneally asked the Minister for Agriculture, Food and Rural Development when payment in respect of sheep and beef cow headage and beef cow and suckler premium will be made to a person (details supplied) in County Waterford; and if he will make a statement on the matter. [25877/99]

The 1999 area aid application for the person named has now been fully processed and any payments due will issue as soon as possible.
