Question:

68 Ms Fitzgerald asked the Minister for Arts, Heritage, Gaeltacht and the Islands the situation regarding the Real Tennis Association's tennis court at Earlsfort Terrace, Dublin 4; and if she will make a statement on the matter regarding future plans. [2920/00]

The property at Earlsfort Terrace, Dublin 2 to which the Deputy refers is owned by the State and is occupied by UCD as an engineering laboratory. In June 1999 An Bórd Pleanála upheld the decision by Dublin Corporation to grant planning permission for the provision of a recital hall for the National Concert Hall by the conversion and refurbishment of the property.

Subsequently a notice of motion was lodged with the High Court by the Irish Real Tennis Association, of its intention to apply for a judicial review of the decision of An Bórd Pleanála.

This matter is being dealt with by the Chief State Solicitor's office, which has advised that the case has not yet been heard by the High Court. Pending a resolution of this issue, no works have been undertaken by Office of Public Works on the site. Until the legal process has been concluded it would be inappropriate to comment further.
