Question:

177 Caoimhghn Ó Caoláin asked the Tánaiste and Minister for Enterprise, Trade and Employment the action, if any, taken by her Department in the unfair dismissal case of a person (details supplied) in County Cavan. [3409/00]

The case under reference was the subject of a determination of the Employment Appeals Tribunal last year in which the EAT granted an award to the employee in question under the Unfair Dismissals Acts, 1977 to 1993 and the Minimum Notice and Terms of Employment Acts, 1973 to 1991.

Representation was made to my Department by the employee's solicitor in July, 1999 advising of non-payment by the employee's employer of the EAT award. My Department followed up on these representations by writing to the employer to request that payment to the employee be effected within a ten-day timeframe. On subsequently hearing from the employee's solicitor that payment within this timeframe had not been effected, my Department, in November 1999, referred the matter to the Chief State Solicitor's office for the institution of legal proceedings against the employer.

I am now advised by the CSSO that certain difficulties have arisen which appear to have implications for the viability of further legal action by me on behalf of the employee. I am having these difficulties assessed by my officials at the moment before deciding what, if any, further action I can take to secure payment to the employee.
