97 Ms Clune asked the Tánaiste and Minister for Enterprise, Trade and Employment if there is a minimum age for persons outside of the country seeking employment here; if her attention has been drawn to a complaint that a large representative body is seeking to recruit candidates from 16 years upwards from abroad to work in the hotel industry; and if she will make a statement on the matter. 118 Mrs. Owen asked the Tánaiste and Minister for Enterprise, Trade and Employment if there is a minimum age for persons outside the country seeking employment here, if her attention has been drawn to a complaint that a large representative body is seeking to recruit candidates from 16 years upwards to come to work in the hotel industry; and if she will make a statement on the matter. I propose to take Questions Nos. 97 and 118 together.

All young persons, that is, 16 to 18 year olds, who are employed in the State, whether national or non-national, are covered by the provisions of the Protection of Young Persons (Employment) Act, 1996. This lays down the conditions under which such young persons may be employed. The Act further provides for the setting of limits to the working hours of young people, provides for rest intervals and prohibits night work.

I am aware of a general increase in the number of applications for work permits to employ non-European economic area nationals in the hotel industry in this country.

I am not clear however which representative body the Deputy is referring to in this instance. If she would like to forward me details I will arrange to have the matter investigated further.
