Question:

329 Mr. Currie asked the Minister for the Environment and Local Government the plans, if any, he has to prevent repeated planning applications in circumstances where An Bord Pleanála has already refused approval on two occasions, as has happened at Laraghcon, Lucan, County Dublin; and if he will make a statement on the matter. [8974/00]

I propose to introduce an amendment on Committee Stage to the Planning and Development Bill, 1999, currently before the Dáil to prevent a planning application being considered while an application for the same development is being considered by An Bord Pleanála on appeal. It would, however, not be appropriate to prevent applications being submitted for development where previous applications have been refused. For example, where a development is refused on particular grounds a modified version of the development could prove acceptable if the grounds for the refusal are satisfactorily dealt with. In addition, such a proposal could effectively sterilise land even in a situation where the planning circumstances of the land have materially changed, for example, where unserviced land is subsequently serviced by roads and underground services.
