Question:

9 Mr. O'Shea asked the Minister for Finance the position in the Circuit Court appeal being taken by the Revenue Commissioners against the decision of the Appeal Commissioner in the case (details supplied) that was the subject of Private Notice Questions in Dáil Éireann on 16 December 1998; and if he will make a statement on the matter. [9359/00]

This is a matter for the Revenue Commissioners. Dealing solely with the question of timing, the Revenue Commissioners have informed me that the full rehearing of the appeal continues to be scheduled to be heard by a judge of the Circuit Court commencing on Tuesday, 4 April 2000.

I accept that there is not a great deal the Minister can say about this issue. I simply want to point out that, even by the normal standards which apply in these cases, there seems to have been an inordinate delay in bringing this appeal to court. Perhaps the Minister would use what little influence he may have to ensure that the delay is minimised.

I understand that the Revenue Commissioners sought to have the case reheard in the latter part of 1999 but that it did not prove possible to obtain the required time in the Circuit Court. The hearing was then fixed for 4 April.
